The New Jersey Appellate Division on Friday declined to revive a redeveloper's lawsuits over Merchantville, New Jersey's refusal to adopt an amendment to a redevelopment plan covering portions of the borough's downtown. The appellate court issued two separate unpublished opinions respectively rejecting Fieldstone Associates LP's suit
seeking to force the Merchantville Borough Council to adopt the amendment and a separate challenge to a recommendation from Merchantville's Joint Land Use Board that the council deny the amendment, which the board found to be inconsistent with the redevelopment plan.
Upholding a dismissal for the borough in the former case, the appellate court found nothing in a 2010 redevelopment agreement between the parties that would require the town to adopt specific plan amendment from Fieldstone. http://bit.ly/1IV7UCG
